Purpose. The article is aimed to study the anthropological, socio-philosophical and philosophical-legal dimensions of the ontological sphere of human life within the discourse of restricting human rights during pandemic threats. To do this, one should solve a number of tasks, among which are the following: 1) to explore the anthropological and praxeological understanding of fear as a primary component of human existence in a pandemic, which prevents people from changing their lives for the better and healthier, having fun and happiness; (...) 2) to put a focus on the habituation of fear as a two-dimensional adaptation to risks and threats from pandemics; 3) to reflect the anthropological features of changes in human life experience under the influence of the COVID-19 pandemic in the discourse of human rights and public health measures. Theoretical basis. Today, international guiding principles on human rights response to global natural threats have been updated. However, there are still no specific legal recommendations concerning measures on human rights protection during outbreaks of various infectious diseases. However, the influence of unexpected global challenges causes a change in the anthropological component of society and the state, so it requires immediate comprehensive research. Originality. It was substantiated a systematic approach to the implementation of modern healthcare policy towards the recognition of human life as the highest value, increasing the level of psychological preparedness for pandemic challenges and approximation of statutory provisions of human rights protection to modern challenges and threats to the health of the individual, society and state. The study of anthropological, socio-philosophical and philosophical-legal dimensions of human existence in the discourse of pandemic threats made it possible to reveal the profound influence of fear on human life, social justice and, consequently, identify the moral and legal dependence of the development level of society and the state on the level of axiological and anthropological concept of human dignity. Conclusions. Based on the study of statistical reports, international analysis and the use of personal authorial methods, the following can be stated: the methods of combating the modern pandemic have directly affected everyone on national and international level. Their influence is significant because it changes the rules of coexistence and life of people in all spheres. However, the influence on the consciousness and other intentions of the individual has mostly temporally insignificant limits. (shrink)

Purpose. Based on the comparative analysis of the European and post-Soviet countries, the purpose of the article is to study one of the manifestations of gender discrimination, namely the problem of gender equality in the sphere of labor. It involves the consistent solution to the following tasks: a) to emphasize the basic principles of gender international and legal policy; b) to reflect the praxeological dimension of providing the equal social and economic opportunities for men and women at current level; c) (...) to emphasize the key criterion for ensuring the equality in socio-cultural sphere – equality in political life; d) to study the educational level of women and the possibility of self-realization in employment equal to men. Theoretical basis. The authors proceed from the standpoint that gender equality at the present stage has become a priority of legal policy and an important principle of the state of pro-European orientation. It is characterized in the legal plane, first of all, by the equality of the social roles of men and women, and the overcoming of the gender hierarchy of social ties, in which men are perceived as higher beings by their mental and physical abilities, and their activities are more significant and of priority in comparison with the activities of women. Originality. The authors have substantiated that in many economically developed countries the problem of providing a gender is still relevant, but most of the crisis problems in this area have found their legal regulation. The motivated position of the authors is that the level of education and professionalism of women cannot serve a reason for discrimination against women, which now exists in the economic and political sphere in the post-Soviet space. Conclusions. Gender stereotypes remain the priority in woman’s keeping family household, which creates significant inequalities of women and men at the labor market. Specialized regulatory acts in the field of gender declare the equality of men and women, while labor law defines a number of norms and guarantees that complicate the employment of women. In order to improve the situation we propose to implement a number of measures, such as, creation and financial support of the programs at the state level for supporting maternity, family and childhood; examination of all normative acts and concerning the issue of gender asymmetry, and especially the norms of labor law; introduction of state monitoring of employment and income of persons as to the complying with the principle of gender equality; introduction of quotas for women’s participation in political activities, in the work of the government and parliament, etc. (shrink)

Purpose. The purpose of this paper is to investigate the anthropological and socio-philosophical dimensions of human existence of the older age group given the challenges of pandemic threats caused by COVID-19. To this end, it is planned to solve a number of tasks, among which one should distinguish the following: 1) to investigate the manifestations of age discrimination in the context of the social and labor areas of human existence; 2) to focus on the asymmetry of the behavior of society (...) and the state relative to persons of the older age group in the field of healthcare in the context of a pandemic crisis; 3) to represent the anthropological features of changes in the socialization and activity of older people under the current conditions of globalization-pandemic challenges. Theoretical basis. Despite such a broad representation of the age-related issue in public relations, there are still no practical guarantees that would apply to discriminatory aspects of older age groups in various areas of their manifestation. The synergistic evolution of social reality requires substantive analysis of the issue under the current conditions for the transformation of social life, which is affected by globalization crises caused by the pandemic threats of COVID-19. Originality. The stereotypical assumptions underlying legal policy and established social relations are based solely on the application of chronological age. The novelty is in justifying an individual approach to the elderly through the personification of the personal characteristics of a person. The study of anthropological and socio-philosophical dimensions of the existence of a person of the older age group in the face of the challenges of pandemic threats caused by COVID-19 has made it possible to analyze the destructive nature of age discrimination in the context of the social and labor areas of human existence. As well as focus on the asymmetry of the behavior of society and the state in relation to these persons in the field of health care, and emphasize the anthropological features of changes in the socialization and human activity under the current conditions of globalization-pandemic challenges. Conclusions. External threats to human existence call for special attention to the implementation and protection of human rights, freedoms, individual freedoms, and identity. Pandemic threats have transformed all dimensions of human existence, especially for those groups of society that are less socially protected. The pandemic crisis has created additional grounds for discrimination against older people in various areas of human existence. Equalization of persons by age without personifying the personal characteristics of an individual is discrimination on an age basis, which violates the principles of democracy and humanism in the society, leads to stigmatization of the person, is the cause of the anthropological crisis of a person. DoughertyTHOMAS AQUINAS’S ACCOUNT of the infused virtue (habitus) of faith presupposes that some intrinsically intelligible truths are beyond the range of the natural cognitive abilities of human beings. The possession of the virtue of faith allows the believer to transcend certain natural epistemic limitations so that he can assent to truths that are necessary (...) for salvation. Consonant with the Catholic theological tradition, Aquinas refers to such truths as the articles of faith (articuli fidei), and stock examples include propositions concerning the Trinity and the Incarnation.1In light of the many and well-known texts from the Corpus Thomisticum that highlight the disproportion or incommensurability between the articles of faith and the natural cognitive abilities of human beings, it would not be unreasonable for one to assume that faith is required to assent to such articles of faith [End Page 1] in this life. Such an interpretive assumption could be expressed as:A1: A human being can assent to the articles of faith in this life if and only if the human being is fortified with the infused virtue of faith.One might be led to ascribe A1 to Aquinas when one considers that he criticizes the Pelagians precisely for maintaining that the assent to matters of faith is caused by nothing other than free will.2 Still further, one might think that strong evidence for A1 is Aquinas’s claim that “free will does not suffice for believing, since those things that are of faith are above reason.”3I argue, however, that A1’s identification of the virtue of faith as a necessary condition for the assent to the articles of faith does not adequately reflect Aquinas’s position, despite the many texts that may suggest such a view.4 That Aquinas does not endorse A1 can be made evident by examining his largely overlooked account of the epistemic state of the heretic (haereticus). To be sure, most commentators who explore the Thomistic treatment of heresy focus on the psychology of error underlying the heretic’s denial of one or more of the articles of faith.5 In the present paper I take an alternate path, however, focusing on those epistemic acts whereby the heretic gets its [End Page 2] right, so to speak, by correctly assenting to some of the articles of faith. Aquinas maintains that the heretic does not possess the infused virtue of faith yet still assents to all the articles of faith except for the one or more articles that he denies. Bereft of faith, the heretic “holds those things that are of faith by another mode than through faith.”6 This seemingly anomalous epistemic condition deserves consideration.7I. Intellects without FaithThe heretic appears to be cognitively privileged, since without faith he assents to the things that are of faith, seemingly overcoming without divine assistance the aforementioned disproportion between the limited range of reason and the articles of faith. Aquinas is aware of the apparent difficulty; in the Summa theologiae he defuses the rather unusual objection that heretics appear to have greater cognitive capacities than the faithful, since heretics routinely and unassistedly assent to those higher truths without possessing the virtue of faith.8 Aquinas concludes that the heretic holds the articles of faith by opinion (opinio), not faith.What makes one a heretic? Nearly all attempts to include Aquinas among the class of divine command theorists have focused on two kinds of texts: those exhibiting Aquinas’s treatment of the apparent immoralities of the patriarchs (e.g., Abraham’s intention to kill Isaac), and those pertaining to Aquinas’s discussion of the divine will. In the present paper, I lay out a third approach unrelated to these two. I argue that Aquinas’s explicit endorsement of one ethical proposition as self-evident throughout his writings is sufficient justification to include (...) Aquinas among the class of divine command theorists. I examine Aquinas’s persistent contention that the proposition “the commands of God are to be obeyed” is a self-evident or per se nota proposition of ethical reasoning, and I then trace Aquinas’s appeals to it in the Sentences commentary, De Veritate, and Quodlibet 3. I conclude with a discussion of passages where Aquinas argues that the experience of moral necessity or obligation requires reference to divine commands. (shrink)

Giovanni Pico della Mirandola is best known for his Oratio, one of many works containing his promise to prove that the philosophies of Plato and Aristotle are in agreement. Pico never fulfilled this promise, however, and commentators have at times derided Pico’s concordist project. The present paper argues that Pico’s notion of concordia was at least partly inspired by a jurisprudential habit derived from his early training in canon law. After examining Pico’s explicit but dispersed statements on concordia, I then (...) consider the circumstantial evidence for a jurisprudential origin to Pico’s project. As the habits and dispositions of Renaissance exegetes differed significantly from those of present-day interpreters of the history of philosophy, there is merit in looking beyond traditional disciplinary boundaries to understand Pico’s attempted concordia of Plato and Aristotle. An appreciation of this context mitigates the negative assessments of his enterprise. (shrink)

The basis of the article is the latest publications devoted to social and humanitarian aspects of biobanking and Russian experience of the initial formation of this subject domain. Packing optimization problems have a wide spectrum of real-word applications. One of the applications of the problems is problem of placement of containers with spent nuclear fuel on the storage platform. The solution of the problem can be reduced to the solution of the problem of finding the optimal placement of a given set of congruent circles into a multiconnected domain taking into account technological restrictions. A mathematical model of the prob-lem is constructed and its peculiarities are considered. Our approach (...) is based on the mathematical modelling of rela-tions between geometric objects by means of phi-function technique. That allowed us to reduce the problem solving to nonlinear programming. Today, an important scientific problem is the problem of creating conditions for safe storage of spent nuclear fuel. In the process of creating any dry spent nuclear fuel storage, the following main stages can be identified: site selection, storage design, construction, operation and decommissioning. A full check for compliance of the repository and its elements with these standards usually begins at the design stage. At the stage of site selection, the inspection for compliance with safety standards is carried out only in terms of the impact of the repository as a whole on the environment. This approach cannot be considered fully appropriate, because, taking into account, for example, all the climatic features of the future storage site, it is possible to adjust the thermal storage regimes of spent nuclear fuel. Similarly, it can be considered necessary to analyze and select the shape of the storage site in order to accommo-date the maximum possible number of spent fuel containers. Such a choice, obviously, should be made taking into ac-count the norms of nuclear, radiation and thermal safety, as well as in compliance with technological limitations. The problem of finding the optimal placement of containers taking into account the given technological limitations can be formulated in the form of the problem of optimization of geometric design. Therefore, the purpose of the study is to build a mathematical model of the problem and study its characteristics to develop effective methods of solution. The proposed approach is based on mathematical modeling of relations between geometric objects using the method of phi-functions. This allowed to reduce the solution of the problem to the problem of nonlinear programming. (shrink)

Ghazālī’s The Incoherence of the Philosophers is an unusual philosophical work for a number of reasons, not the least of which is the author’s explicit disavowalof any of the conclusions contained within it. The present essay examines some of the hermeneutical challenges that face readers of the work and offers anexegetical account of the much-neglected Third Discussion, which examines a key point of Neoplatonic metaphysics. The paper argues that Ghazālī’s maintaining of the incompatibility of metaphysical creationism and Neoplatonic emanationism should (...) not be viewed as simply a rhetorical or dialectical argument, but rather is best understood, to use Ghazālī’s words, as a philosophical “proof.” Essential to this proof in the solution to the argument of the Third Discussion is an implicit theory of metaphorical predication that can be pieced together from several of Ghazālī’s remarks as well as a reductio ad absurdum argument about the very possibility of ethical discourse. Thomas Aquinas's Disputed Questions on Evil is a careful and detailed analysis of the general topic of evil, including discussions on evil as privation, human free choice, the cause of moral evil, moral failure, and the so-called seven deadly sins. This collection of ten, specially commissioned new essays, the first book-length English-language study of Disputed Questions on Evil, examines the most interesting and philosophically relevant aspects of Aquinas's work, highlighting what is distinctive about it and situating it in relation not (...) only to Aquinas's other works but also to contemporary philosophical debates in metaphysics, ethics, and philosophy of action. The essays also explore the history of the work's interpretation. Background: Providing nursing care for patients with end-stage renal disease entails dealing with existential issues which may sometimes lead not only to ethical problems but also conflicts within the team. A previous study shows that physicians felt irresolute, torn and unconfirmed when ethical dilemmas arose. Research question: This study, conducted in the same dialysis care unit, aimed to illuminate registered nurses’ experiences of being in ethically difficult situations that give rise to a troubled conscience. Research design: This study has a (...) phenomenological hermeneutic approach. Participants: Narrative interviews were carried out with 10 registered nurses working in dialysis care. Ethical considerations: The study was approved by the Ethics Committee of the Faculty of Medicine, Umeå University. Results: One theme, ‘Calling for a deliberative dialogue’, and six sub-themes emerged: ‘Dealing with patients’ ambiguity’, ‘Responding to patients’ reluctance’, ‘Acting against patients’ will’, ‘Acting against one’s moral convictions’, ‘Lacking involvement with patients and relatives’ and ‘Being trapped in feelings of guilt’. Discussion: In ethically difficult situations, the registered nurses tried, but failed, to open up a dialogue with the physicians about ethical concerns and their uncertainty. They felt alone, uncertain and sometimes had to act against their conscience. Conclusion: In ethical dilemmas, personal and professional integrity is at stake. Mistrusting their own moral integrity may turn professionals from moral actors into victims of circumstances. To counteract such a risk, professionals and patients need to continuously deliberate on their feelings, views and experiences, in an atmosphere of togetherness and trust. (shrink)

By using a tomographic approach to quantum states, we rise the problem of nonlocality within a single particle (single degree of freedom). We propose a possible way to look for such e®ects on a qubit. Although a conclusive answer is far from being reached, we provide some re°ections on the foundational ground.

In Boethius’s Consolatio Philosophiae one finds a rather unusual argument contending that human beings can lose their natures as the result of immoral or virtuous activity. A number of texts in the work argue that the polarities of beast and god serve as options for those who lead highly immoral or highly virtuous lives. This argument is examined in detail in light of its philosophical ancestry. I argue that those who think the Boethian doctrine is Platonic in origin tend to (...) read the texts about the loss of human nature as metaphorical. I then suggest that if one places the argument in an Aristotelian context one is able to see it as a metaphysical argument, and moreparticularly, as part of Boethian psychology. This paper thus provides a new context for approaching Boethius’s contention that human beings can lose their natures. (shrink)

Context. The identification of the sources that reionized the Universe and their specific contribution to this process are key missing pieces of our knowledge of the early Universe. Faint star-forming galaxies may be the main contributors to the ionizing photon budget during the epoch of reionization, but their escaping photons cannot be detected directly due to inter-galactic medium opacity. Hence, it is essential to characterize the properties of faint galaxies with significant Lyman continuum photon leakage up to z 4 to (...) define indirect indicators allowing analogues to be found at the highest redshift. Aims. Long gamma-ray bursts explode typically in star-forming regions of faint, star-forming galaxies. Through LGRB afterglow spectroscopy it is possible to detect directly LyC photons. Our aim is to use LGRBs as tools to study LyC leakage from faint, star-forming galaxies at high redshift. Methods. Here we present the observations of LyC emission in the afterglow spectra of GRB 191004B at z = 3:5055, together with those of the other two previously known LyC-emitting LGRB, to determine their LyC escape fraction and compare their properties. Results. From the afterglow spectrum of GRB 191004B we determine a neutral hydrogen column density at the LGRB redshift of og =17:2 0:15, and negligible extinction. The only metal absorption lines detected are C iv and Si iv. In contrast to GRB 050908 and GRB 060607A, the host galaxy of GRB 191004B displays significant Ly emission. From its Ly emission and the non-detection of Balmer emission lines we constrain its star-formation rate to 1 SFR 4:7 M yr. 1. We fit the Ly emission with a shell model and find parameters values consistent with the observed ones. The absolute LyC escape fractions we find for GRB 191004B, GRB 050908 and GRB 060607A are of 0:35+0:10.0:11, 0:08+0:05.0:04 and :20+0:05.0:05, respectively. We compare the LyC escape fraction of LGRBs to the values of other LyC emitters found from the literature, showing that LGRB afterglows can be powerful tools to study LyC escape for faint high-redshift star-forming galaxies. Indeed we could push LyC leakage studies to much higher absolute magnitudes. The host galaxies of the three LGRB presented here have all M1600 >.19:5 mag, with the GRB 060607A host at M1600 >.16 mag. LGRB hosts may therefore be particularly suitable for exploring the ionizing escape fraction in galaxies that are too faint or distant for conventional techniques. In this article, we argue that scientists and technologists associated with the nuclear industry are building support for small modular reactors by advancing five rhetorical visions imbued with elements of fantasy that cater to various social expectations. The five visions are as follows: a vision of risk-free energy would eliminate catastrophic accidents and meltdowns. A vision of indigenous self-energization would see SMRs empowering remote communities and developing economies. A vision of water security would see SMR-powered desalination plants satisfying the world’s (...) water needs. A vision of environmental nirvana would see SMRs providing waste-free and carbon-free electricity to preserve the earth’s biosphere. A vision of space exploration would see SMRs assisting in the colonization of the moon, Mars, and possibly other worlds. These visions help create a symbolic convergence among promoters, serving to attract political and financial support, and erasing previous nuclear failures from public discourse. Moreover, underlying these visions is a technological utopian ideal world where SMRs would generate plentiful energy of multiple kinds, offering the necessary means for a life of comfort for all people by meeting various needs and without any environmental externalities or cause for concern about accidents.
